LLNE Website, Discussion List and Electronic Communication Policy

LLNE Web Content

The Law Librarians of New England (LLNE) offers information and services on the World Wide Web (web, online, electronic) in furtherance of its educational mission and of its non-profit purposes. Web content is distributed through the LLNE web site, the LLNE News blog and other social or electronic media, including but not limited to Facebook, Twitter, and any other format of electronic distribution approved by the LLNE Executive Board. The LLNE web content includes all LLNE publications (electronic and those that can be converted to electronic format) of LLNE and of its member committees. The LLNE web content also contains external links to sites that are of interest to LLNE members, with particular focus on New England law library related resources.

Information to be distributed through any LLNE electronic media, or for updating or posting to any preexisting LLNE web page should ordinarily be submitted to the LLNE Communications & Technology Committee Chair for evaluation.

All LLNE website posting is controlled by the LLNE Webmaster after review by the LLNE Executive Board.  However, any LLNE documents or information that meet all of the following criteria are automatically eligible for any form of electronic posting or online distribution without prior approval of the Communications & Technology Committee or its Chair:

a. Anything submitted by a Committee Chair or an Executive Board Member;

b. Anything that pertains to the Committee’s or Board Member’s area of assigned responsibility;

c. Anything that meets one of the following qualifications:

i. Information that pertains to LLNE business, including, but not limited to:  Reports, Documents, Press releases, or other LLNE policies;

ii. Information that is produced by an outside organization but is approved by an LLNE Committee Chair or Executive Board Member;

iii. Information that does not advertise or imply endorsement of any product.  External links from the LLNE site may not imply endorsement of the external site’s products or services by LLNE.

All information that is not automatically eligible for electronic posting will be considered by the LLNE Communications & Technology Committee to determine whether it furthers the educational mission and non-profit purposes of LLNE and whether it is appropriate for distribution by LLNE.

The LLNE does not allow third parties to post any content to the LLNE web site or through any other method of electronic distribution sponsored by LLNE.  Any third-party materials submitted to LLNE for approval by the LLNE Executive Board will be posted to the LLNE web page by the LLNE Webmaster or to any other electronic media facilitated by LLNE members with the following disclaimer:  This information is posted for informational purposes only and does not express the opinion of LLNE members or endorsement by the LLNE Executive Board.  The LLNE is not responsible for any claims or damages which may result from any use of this information.

LLNE Committee Chairs and Board Members should submit documents for electronic distribution by LLNE in electronic form, whenever possible.

All LLNE electronic distribution, with the exception of forms and documents, will include the following elements:  the LLNE logo, title, date last updated, LLNE copyright notice, and LLNE member contact name.  These elements will be arranged in a web template approved by the LLNE Communications & Technology Committee.

The LLNE Communications & Technology Committee will endeavor to maintain the original format of any document submitted to LLNE for electronic distribution whenever possible.  Reformatting documents for electronic posting may be necessary to maintain uniformity with other LLNE web documents.

The LLNE Communications & Technology Committee will update or will remove information or documents from any LLNE web page or electronic posting upon request of any LLNE Committee chair or Board Member or upon discretion of the Communications & Technology Committee chair whenever information posted to the LLNE site becomes outdated.

Permission to use, copy and distribute material from any LLNE electronic source is hereby granted for private, non-commercial and educational purposes only with acknowledgement of LLNE copyright and with the following notice:  This material may be reprinted and distributed for non-commercial and educational purposes only, and not for resale.  No resale use may be made of information or documents posted to this electronic content at any time.  All other rights are reserved.

The names and logos of the Law Librarians of New England may not be used for any purpose without specific, written prior permission from the LLNE Executive Board. The LLNE makes no representation about the suitability of information for any purpose.  It is provided “as is” without express or implied warranty.

LLNE List Rules and Conditions

The following are the rules and conditions of participation in the LLNE List.  The LLNE List is for the exclusive use of LLNE members and is managed by the LLNE List Manager.  By subscribing to and participating in the LLNE List, LLNE members agree to be bound by and warrant their full compliance with the following terms of participation:

The LLNE List is an online discussion forum provided for the Law Librarians of New England in furtherance of its nonprofit and tax-exempt purposes.  The LLNE List may be used only by LLNE members and only for the purpose of discussing matters related to or arising out of the Law Librarian profession by LLNE.

The LLNE accepts no responsibility for the opinions and information posted on this LLNE List by its members. The LLNE disclaims all warranties with regard to information posted on the LLNE List by its members; this disclaimer includes all implied warranties of merchantability and fitness.  In no event shall LLNE be liable for any special, indirect or consequential damages, or damages of any kind whatsoever, resulting from loss of use, data or profits, arising out of or in conjunction with the use or performance of any information posted on the LLNE List by its members.

The LLNE members will not post any defamatory, abusive, profane, threatening, offensive, or illegal information or material, and will not use the LLNE List in any illegal manner.  The LLNE members will not post any information or other material protected by another copyright without the permission of the copyright owner.  The LLNE members will not use any words, logos or other marks that would infringe upon the trademark, service mark, certification mark, or other intellectual property rights of the owners of such marks without the permission of such owners.  The LLNE members will not post any confidential information or any other information that would infringe upon the proprietary, privacy or personal rights of others.

By posting material, the posting party warrants and represents that it owns the copyright with respect to such material, has received permission from the copyright owner, or that the material is in the public domain.  The posting party further warrants and represents that it otherwise has the full and unencumbered right to post such material and that such posting will not infringe any rights or interests of others.  In addition, any LLNE member posting to the LLNE List grants LLNE and users of the LLNE List a non-exclusive, irrevocable license to display, copy, publish, distribute, transmit, print, and use such information or material in any manner, without payment.

The LLNE List shall not be used in any manner that violates federal or state antitrust laws or other laws prohibiting anticompetitive practices.  The antitrust laws generally prohibit any agreement or understanding inconsistent with the right and obligation of competitors to exercise independent business judgment in pricing their products or services, dealing with their customers and suppliers, and selecting the markets in which to compete.  No express agreement or understanding is required:  one can be inferred from statements or conduct.  The LLNE members will not post any information regarding specific prices or fees charged or paid, and will not post any information concerning prices, pricing practices, discounts, or other terms or conditions of sale either obtained by or offered to another entity.  The LLNE members will not post any information concerning market shares, salaries, costs, sales territories, profit margins, or anything that encourages the selection or rejection of customers or suppliers.

All postings to the LLNE List shall be of an informational nature and for informational purposes only.  Commercial use or any other unauthorized use of the LLNE List is prohibited.  The LLNE List will not be used to solicit or conduct business, including the direct or indirect marketing of users’ products or services, in any manner.  The LLNE List will not be used to provide information, materials, products, or services in exchange for compensation of any kind.

The LLNE List is not generally monitored for inappropriate postings, and LLNE does not, on its own undertake editorial control of postings.  However, in the event that any inappropriate posting or unauthorized use of the LLNE List is brought to the attention of the LLNE List Manager, or to the attention of any LLNE Committee Chair or to the attention of any member of the LLNE Executive Board, including but not limited to prohibited posting and usage as outlined herein, LLNE will take all appropriate action, in its sole discretion.  The LLNE reserves the right to terminate, without prior notice, the LLNE List access of any LLNE member who does not abide by these guidelines.
